These terms are a contract between you and Nicholas Ortiz, doing business as Heater Stats (“Heater Stats,” “we,” “us”) for your use of https://www.heaterstats.com and everything we provide through it (the “Service”). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.
Heater Stats publishes statistics, visualizations, and analysis about National Hockey League games and players, for informational and entertainment purposes.
Free. The free plan gives access to a limited set of features. We may change what the free plan includes at any time.
Pro monthly ($20 per month). A subscription that renews automatically each month until you cancel. Cancel any time from the Plan page (“Manage billing”); cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then. We do not prorate or refund partial months except where the law requires it.
Pro season pass ($100, one-time). A single payment for Pro access through June 30, 2027 (the end of the 2026-27 playoffs). It does not renew. You may request a full refund within 7 days of purchase; after that the pass is non-refundable except where the law requires it.
Trials and promotions. New accounts receive a free Pro period (currently through October 13, 2026 for accounts created around launch, and 7 days from signup thereafter). When it ends, your account moves to the free plan unless you purchase Pro. We may change or end promotions at any time; changes do not affect a period already granted.
Prices and taxes. Prices are in U.S. dollars and exclude any taxes we are required to collect. We may change prices; a change to a subscription price takes effect at your next renewal after we give you at least 14 days’ notice, and you can cancel before it applies.
Payment processing. Payments are handled by Stripe under Stripe’s terms. By purchasing you authorize us and Stripe to charge your payment method. If a renewal payment fails we may retry it for a short period and then downgrade your account to the free plan. If you dispute a charge with your bank rather than contacting us, we may suspend your account while the dispute is resolved.
You may use the Service for your own personal, non-commercial purposes. You agree not to:

The Service, including its design, code, text, visualizations, models, and derived metrics, is owned by Nicholas Ortiz, doing business as Heater Stats or its licensors and protected by copyright and other laws. Subject to these terms we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service. Underlying sports facts are not owned by anyone; our particular selection, arrangement, presentation, and derived analysis are ours.
You can stop using the Service or ask us to delete your account at any time by emailing support@heaterstats.com. We may suspend or terminate your account if you breach these terms, if required by law, or if we discontinue the Service; if we terminate a paid plan without cause, we will refund the unused portion. Sections 1, 4, 5, and 7 through 10 survive termination.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY STATISTIC, MODEL OUTPUT, OR VISUALIZATION IS CORRECT. YOU USE THE SERVICE, AND ANY DECISION BASED ON IT, AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, NICHOLAS ORTIZ, DOING BUSINESS AS HEATER STATS AND ITS OWNERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY WAGERED, LOST PROFITS, OR LOST DATA, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE (OR $20 IF YOU PAID NOTHING). Some jurisdictions do not allow some of these limitations, so they may not fully apply to you.
You agree to defend and indemnify Nicholas Ortiz, doing business as Heater Stats against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these terms or your unlawful use of the Service.
These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@heaterstats.com and try in good faith to resolve it informally for 30 days. Any claim that is not resolved will be brought exclusively in the state and federal courts located in North Carolina, and you consent to their jurisdiction. Either party may bring an individual claim in small-claims court. You agree that claims may be brought only on an individual basis, not as a class or representative action.
We may update these terms. We will post the new version here with a new effective date, and for material changes we will notify account holders by email or an in-app notice at least 14 days before they take effect. Continuing to use the Service after that means you accept the changes.
These terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. If any part is unenforceable, the rest remains in effect. You may not transfer your account or these terms; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a term is not a waiver.
